Preamble

The General Terms and Conditions of Sale stated thereafter and defined as "the Conditions" apply to all transactions made by the user ("the Buyer") on the website Lechamois-wool.com ("the Seller").

Article 1: Acceptance of the Conditions and their potential modifications 

It is the Buyer's responsibility to read and acknowledge the Conditions written below. The Conditions are available at all times on the website www.lechamois-wool.com. However, if the Buyer wishes to receive the Conditions via email, he / she can request them directly. The Buyer is liable for keeping up to date with potential changes in the Conditions which can be made at any time at the discretion of Lechamois-wool.com. The Buyer can do so by reading the website or making a request to the customer service of Le Chamois Switzerland to receive the updated Conditions via email. Prior to any transaction being made on the website Lechamois-wool.com, the Buyer must agree to the General Terms and Conditions of Sale by ticking the corresponding box. In doing so, the Buyer confirms the acknowledgment and the unconditional acceptance of the Conditions.

Article 2: Object

The Conditions hereafter describe in details the rights and liabilities of the Buyer and Le Chamois Switzerland regarding all transactions made on the website Lechamois-wool.com. You will find general conditions about orders, sales, services as well as delivery and payment terms.

Article 3: Orders

3.1. Before placing an order on the website www.lechamois-wool.com, it is the responsibility of the Buyer to ensure that he / she is able to engage in a contract in accordance with the law. When placing an order, the Buyer implicitly states that he / she has the capacity to be legally bound by a contract.      

Le Chamois Switzerland reserves the right to decline the request from a Buyer who would like to place an order on the website www.lechamois-wool.com, particularly if the Buyer is involved in litigation with Le Chamois Switzerland regarding an unpaid order.   

3.2. Order Placement 

Orders can be placed continuously on the website www.lechamois-wool.com 24 hours a day, 7 days a week. When placing an order, the Buyer automatically accepts without reservations the Conditions, the prices, and the products he / she is ordering as they are described on the website. To place an order through the website www.lechamois-wool.com, the Buyer has to select a payment mode before making a payment via an entirely secure payment platform made available to him / her.   

3.3. Order confirmation 

If no entry error was made by the Buyer, he / she will receive an automatic email stating that the order has been confirmed. The Buyer must ensure that the data which were passed on to Le Chamois Switzerland are correct. Le Chamois Switzerland is not responsible for any delivery delay or issue arising from an entry error on the Buyer's part. Reshipping costs will be charged to the Buyer.  

3.4. Order tracking

The expedition date, the delivery date and the delivery status of the parcel can be checked under the section called "My account / My orders". The Buyer can also go to the website of the carrier to track the parcel. Once the parcel has been handed over to the carrier, Le Chamois Switzerland cannot be held responsible for the goods in transit, that is to say, the condition of the goods and any delivery delay or error. Le Chamois Switzerland remains at the disposal of the Buyer who would like to have more information regarding his / her parcel status.

Article 4: Order

4.1. Descriptions and characteristics of the products 

When placing an order through the website www.lechamois-wool.com, the Buyer declares being aware that descriptions and pictures of the products for sales through the website www.lechamois-wool.com are non-contractual. Even if Le Chamois Switzerland does its best to ensure product descriptions are as detailed as possible and pictures are as accurate as possible, the Seller cannot be liable for any difference in the product appearance or functionality the Buyer may note.   

4.2 Product availability 

Le Chamois Switzerland must ensure that orders are handled. However, the Buyer must be aware that stock at Le Chamois Switzerland or its suppliers may vary which might occasionally prevent the Seller from handling an order: the stock which is listed on the website might differ from the actual stock which is available at this moment in time, even though Le Chamois Switzerland endeavors to update product availability status on the website on a regular basis. In the event that the order cannot be handled or is delayed from its original delivery date due to stockout at Le Chamois Switzerland or at one of its suppliers, the Buyer will be informed via email as soon as possible that the product which has been ordered is no longer available. The Buyer will be able to either cancel his / her order or exchange the products which are no longer available for any other articles available on the website, or get a full refund within 30 days following the placement of the order at the latest. The Buyer will not be able to request any cancellation compensation from Le Chamois Switzerland.

Article 5: Price

Prices are expressed in Swiss Francs by default and may be shown in Euros according to the Buyer's preferences: in both cases, prices include all taxes (except delivery cost, promotional offers and personal voucher) and are applicable throughout the transaction process. Le Chamois Switzerland reserves the right to change the prices at its sole discretion, at any time and without justification.   

Depending on his / her location, the Buyer, who uses the website www.lechamois-wool.com through his / her personal account, will either see the prices including all taxes (Swiss residents will have to pay VAT) or the prices excluding tax (for the Internet users who reside outside of Switzerland and who do no need to pay VAT but who might have to pay customs duty on top of the cost of the product depending on where they live). If the Buyer does not reside in Switzerland, it is his / her responsibility to find the information regarding customs duty which are applicable to his / her country as Le Chamois Switzerland has no legal obligation to provide him / her with this information

Article 6: Payment

6.1. Payment methods 

The Buyer pays for the orders through the website www.lechamois-wool.com with either a Visa Card, a Eurocard-Mastercard, a Post Finance card or by e-Finance. It is the Buyer's responsibility to ensure that he / she has sufficient funds and authorizations to pay his / her products when he / she proceeds to checkout. The cost of the order is debited from the Buyer's bank account when the order is being handled. When the Buyer uses the website www.lechamois-wool.com, his / her data are protected by the SSL secure payment gateway (Secure Socket Layer) used by Le Chamois Switzerland to encrypt personal information that the Buyer provides when he / she places an order. If payment from the Buyer is not successful due to authorization failure or for any other reason, Le Chamois Switzerland will be forced to cancel the order and / or the delivery.  

6.2. Invoice

Neither the order form created online by the Buyer nor the order confirmation sent via email by Le Chamois Switzerland serves as a substitute for a printable invoice in due form available to the Buyer via his / her personal account on the website www.lechamois-wool. com from the moment he / she places an order.  

6.3. Transfer of ownership

The products which have been ordered by the Buyer remain the property of Le Chamois Switzerland until the order is paid in full by the Buyer. Notwithstanding the conditions of transfer of ownership mentioned above, the Buyer is liable for the products from the moment they are delivered to him / her: he / she takes on the responsibility for any product damage or loss.

Article 7: Delivery

7.1. The products are delivered to the address provided by the Buyer when he / she placed an order with Le Chamois Switzerland.  

7.2. Delivery areas 

Le Chamois Switzerland ships to Switzerland and the entire world.  

7.3. Delivery services 

The Buyer must ensure that the data which were passed on to Le Chamois Switzerlnd are correct. Le Chamois Switzerland is not responsible for any delivery delay or issue arising from an entry error on the Buyer's part. Reshipping costs will be charged to the Buyer.  

7.4. Expedition and delivery time 

Le Chamois Switzerland does its very best to handle order in a timely manner. Therefore, orders which are placed before 4pm are handled and shipped on the same day within the realms of possibility and depending on the volume of orders which need to be handled by Le Chamois Switzerland on this particular day.  It might take up to 2 working days for Le Chamois Switzerland to handle orders depending on the products.  In any case, Le Chamois Switzerland endeavours to handle the orders that are placed online between Monday and Friday, excluding bank holidays and holidays mentioned on the homepage of the website. After receiving the confirmation email regarding his/her order, the Buyer is able to assess the delivery time (expressed in working days) of the order by reading the table below.

Switzerland, PostPac Priority  - 24 to 48 houts - CHF 11-

Switzerland, PostPac Economy -  48 to 72 hours - CHF 9-

Europe,  Swiss Post, International service - 2 to 7 days - CHF 15-

Rest of World, Swiss Post, International service - 3 to 15 days - CHF 20-

* To organise a special or personalised delivery, please get in touch with the customer service of Le Chamois Switzerland. 

** Delivery times are calculated from the moment the parcel has been shipped. The orders which have been placed before 4pm will be handled and shipped by Le Chamois Switzerland on the same day within the realms of possibility, provided that the products are in stock.

7.5. Giftbox

The Buyer has the possibility to request a branded giftbox for free.  This service is only available for small products. 

7.6. Buyer's liability for checking the parcel upon delivery 

It is the Buyer's responsibility to check that the parcel is in good condition upon delivery while the carrier is present, so that the Buyer is able to flag any problem regarding the product to the carrier and Le Chamois Switzerland (within 2 working days following the delivery). This includes damaged parcel and delayed delivery. If the Buyer has not checked the parcel before signing the delivery form, Le Chamois Switzerland will not take into consideration any claim regarding the condition of the parcel. 

7.7. Delivery delays due to the carrier

If the Buyer notes a delay in the delivery compared to the delivery time mentioned in the table above, he/she must get in touch with the carrier responsible for the parcel delivery. If the parcel delivery is pending, please call Le Chamois Switzerland customer care or send us an email describing the situation and providing information regarding your order so we are able to start investigating to find your parcel as soon as possible. Another option is to file a claim. 

7.8. Damaged parcel 

It is the Buyer's responsibility to check that the parcel is in good condition in front of the carrier upon delivery. If the Buyer has not voiced any concern upon delivery before signing the delivery form, Le Chamois Switzerland will consider that the parcel is in keeping with the Buyer's expectations and will not take into consideration any claim that is made after 2 working days following the delivery.

Article 8: Returns and Exchang

Dans le cas où le Client souhaiterait retourner sa commande pour demander un échange ou un remboursement, il devra prendre contact avec le service client de Le Chamois Switzerland par téléphone ou e-mail pour l’en avertir et disposera de 7 jours à partir de la réception de sa commande pour le faire. Le service client de Le Chamois Switzerland aura 24 heures pour valider la demande de retour et indiquer au Client comment procéder. De même, Le Chamois Switzerland met tout en oeuvre pour effectuer les remboursements de ses Clients dans le cadre d’un retour, dans les 30 jours suivant la réception des produits retournés. Il est convenu que les retours de commande sont intégralement à la charge du Client, qui renverra les produits reçus neufs dans leur emballage d’origine et prêts à la revente. Dans le cas où Le Chamois Switzerland réceptionnerait des produits détériorés, incomplets ou usés suite à un retour, il ne saurait accepter de les rembourser ou de les échanger. Certains produits pourront être échangés mais ne seront pas éligibles à un remboursement : il en va ainsi des articles soldés, en promotion ou acquis grâce à un coupon de réduction individuel (code promo).

Article 9: Personal data and privacy policy

9.1. Personal information which is transmitted to Le Chamois Switzerland is not used in any way.  

9.2. Personal information that is shared by the Buyer with Le Chamois Switzerland is exclusively used as part of the order to arrange the delivery, the invoicing and to get in touch with the Buyer or provide him/her with information. The Buyer's personal data might also be used for statistics as part of internal researches to help improve the services of Le Chamois Switzerland in aid of our clients and to support our development.  

9.3. Non-disclosure of information 

Personal information about the Buyer will not be sold, shared nor distributed. Data might be shared with a third party if they have legal authorisation allowing them to request the data or if they belong to Le Chamois Switzerland. 

9.4.Access rights 

When the Buyer places an order or register on the website www.lechamois-wool.com, he/she shares personal information with Le Chamois Switzerland. The Buyer is able to see, edit or delete these data at anytime, whenever he/she wishes to do so. When placing an order or registering on the website, the Buyer can subscribe to the newsletter to keep up to date with the latest news from Le Chamois Switzerland. Equally, the Buyer can decide at any time he/she no longer wants to receive the newsletter from Le Chamois Switzerland. To unsubscribe from the newsletter, the Buyer needs to sign in to his/her account or click on the link at the bottom of the newsletter from Le Chamois Switzerland.  Le Chamois Switzerland endeavours to acknowledge the subscriptions to the newsletter or subscription cancellations as quickly as possible.  

9.5. Security / Privacy 

Le Chamois Switzerland takes all necessary measures to prevent unauthorised third-party from accessing personal information about the Buyer by using a website which is both secure and reliable.  The website also uses advanced and highly efficient protective systems, including firewalls and passwords. Despite all the efforts which are being made by Le Chamois Switzerland on a daily basis to protect the Buyer's personal information from malicious third parties, it remains impossible for the Seller to ensure full data protection online. Therefore, Le Chamois Switzerland cannot be liable if the Buyer's personal information is stolen.

Article 10: Copyright

Le Chamois Switzerland owns all the content uploaded to the website including texts and media in accordance with copyright and intellectual property laws worldwide. Therefore, it is forbidden for website users to copy, plagiarise or steal content from the website unless they have been given permission to do so by Le Chamois Switzerland, at the risk of being prosecuted for counterfeiting.  However, personal usage of the website content is allowed.

Article 11: Limitation of liability 

11.1 When the Buyer uses our websites and, more generally, the Internet, he/she is perfectly aware of the risks associated. The Buyer accepts all responsibility regarding the above, and cannot hold Le Chamois Switzerland responsible.  

11.2 The Buyer cannot hold Le Chamois Switzerland responsible for direct and indirect potential damages (financial, moral or of any kind whatsoever) related to the usage or the inability to use the websites.    

11.3 When using our websites and, more generally, the Internet, the Buyer realises the full extent of the risks and liabilities associated.  Therefore he/she cannot hold Le Chamois Switzerland responsible for damages or potential virus which might damage the computer hardware which was used to access the website of Le Chamois Switzerland or to download dangerous files

Article 12: Applicable law and Competent court 

Transactions between Le Chamois Switzerland and the Buyer are governed by Swiss law.  

In the event of litigation between the two parties, the competent court is located near the headquarter of Le Chamois Switzerland in Lausanne.
